Cervical spondylosis does not fall into the category of occupational diseases. According to the Occupational Disease Prevention and Control Law of the People's Republic of China, occupational diseases refer to occupational hazards caused by workers of enterprises, institutions and individual economic organizations due to exposure to dust, radioactive substances and other toxic and harmful substances during their occupational activities. It must be an occupational disease listed in the occupational disease classification and catalogue published by the state. All four conditions are indispensable. At present, there are 115 statutory occupational diseases in 10 categories promulgated by my country. Among them: 13 types of pneumoconiosis, 11 types of occupational radiation diseases, 56 types of occupational poisoning, 5 types of occupational diseases caused by physical factors, 3 types of occupational diseases caused by biological factors, 8 types of occupational skin diseases, 3 types of occupational eye diseases, 3 types of occupational ear, nose, throat and oral diseases, 8 types of occupational tumors, and 5 other occupational diseases. Occupational hazards include: ① Chemical factors, such as irritating gases like chlorine and ammonia; industrial dust, etc. ② Physical factors, such as high temperature, low temperature, noise, vibration, ionizing radiation, high-frequency electromagnetic fields, ultraviolet rays, etc. ③ Biological factors, such as Bacillus anthracis that causes occupational anthrax in leather workers, livestock product processing workers, etc., and occupational forest encephalitis that causes forest workers. ④ Harmful factors in the labor process, such as long working hours, excessive mental stress, excessive labor intensity, and excessive fatigue of individual organ systems ⑤ Factors related to poor sanitary conditions and technical measures: such as unreasonable design of production sites, lack of protective measures or poor results, lack of safety protection equipment and necessary personal protective equipment, natural environmental factors such as solar radiation in hot seasons, and environmental pollution factors. According to the above four conditions, cervical spondylosis cannot be considered an occupational disease. |
