Natural birth is a way of delivery for pregnant women. After a physical examination, many pregnant women can ensure that the fetus is developing normally, and natural birth is beneficial to the child. Moreover, recovery from normal childbirth is faster, so it is also a better way of delivery for pregnant women. The leave for normal childbirth should be based on the different regulations of each woman’s work unit. So how many days is the leave for normal childbirth? The maternity leave standards currently officially implemented in my country are based on the "Special Provisions on Labor Protection for Female Employees (Draft)" which was reviewed and approved in principle at the State Council Executive Meeting on April 18, 2012. The draft extends the maternity leave for female employees from 90 days to 98 days and standardizes related benefits. Therefore, regardless of whether the mother gives birth by caesarean section or natural birth, she is entitled to 98 days of maternity leave. Female employees are entitled to 98 days of maternity leave, including 15 days of pre-delivery leave. In case of difficult delivery, the maternity leave will be extended by 15 days. In case of multiple births, the maternity leave will be extended by 15 days for each additional baby. If a female employee has a miscarriage before 4 months of pregnancy, she is entitled to 15 days of maternity leave. If she has a miscarriage after 4 months of pregnancy, she is entitled to 42 days of maternity leave. The maternity allowance for female employees during their maternity leave will be paid from the maternity insurance fund based on the employer’s average monthly salary of employees in the previous year for those who have participated in maternity insurance. For those who have not participated in maternity insurance, the employer will pay it based on the female employee’s salary before maternity leave. The medical expenses for childbirth or abortion of female employees shall be paid by the maternity insurance fund for those who have participated in maternity insurance, and by the employer for those who have not participated in maternity insurance, in accordance with the items and standards stipulated in the maternity insurance. During maternity leave, you will enjoy maternity living allowance and maternity medical expenses subsidy in accordance with the law. The standard of monthly maternity living allowance is the urban pension insurance payment base of the month of delivery or abortion. If the payment base of the month is lower than the average monthly wage of employees in the city in the previous year, it shall be calculated based on the average monthly wage of employees in the city in the previous year. If the individual's wage standard is higher than the social insurance payment standard, the excess should still be made up by the employer. |
